Terms of Use

As many guests may not have a private pool in their home and may not know the proper and safe use of a private pool (no lifeguard) we have created this document to ensure ALL guests know the rules and use the pool in a responsible manor.

Your Health and Your safety is paramount to us so use the pool in a responsible manor.


As a guest you agree renting Villa Quietude, the Villa, located at Agios Stefanos, Avliotes, Corfu, on property (the Property) owned by ΕΜΠΟΡΙΚΕΣ - ΚΤΗΜΑΤΙΚΕΣ ΕΠΙΧΕΙΡΗΣΕΙΣ ΑΓΙΟΣ ΣΤΕΦΑΝΟΣ Μ.Ε.Π.Ε. hereinafter called Landlord; and

Whereas, there is a swimming pool (the Pool) located on the Property, and Landlord has warned the guests of the dangers to group that could result from use of the Pool since there is no lifeguard on duty; and

Whereas, the guest has agreed that Landlord is under no duty to supply a lifeguard for said Pool and that guest, their children and guests use the Pool at their own risk; and

Whereas, booking guest has agreed that he/she will be the person responsible for the safe, correct and responsible use of the pool for him/her and guests.

(The following rules are for the safe pool use and MUST be followed)


    • Whereas, guest has agreed that life saving equipment is located around the pool and MUST only be used for this purpose; and
    • Whereas, guest has agreed that the Pool is reserved for you ONLY; you takes FULL responsibility for his/her children and guests; and
    • Whereas, guest has agreed that No Children under 16 are allowed to use the pool unless adult supervision is present; and
    • Whereas, guest has agreed that NO FOOD, GLASS CONTAINERS, OR ALCOHOLIC BEVERAGES allowed in the pool area. No impaired individual allowed in the pool area; and
    • Whereas, guest has agreed that the POOL GATE MUST BE SHUT / latched at all times; and
    • Whereas, guest has agreed that HORSE PLAY, RUNNING, and DIVING is PROHIBITED; and
    • Whereas, guest has agreed that if any persons are SICK or have any OPEN WOUNDS, will not be allowed in the pool area. It is a controlled sanitary area. No blowing nose in water, no spitting or urinating in pool; and
    • Whereas, guest has agreed to report ALL problems to management immediately; and
    • Whereas, guest has agreed that the Landlord reserves the right to revoke the pool access at any time.
    • Whereas, guest has agreed to adhere, follow, convey and enforce ALL the pool rules to his/her guests; and
    • Whereas, guest has assumed the risk of such dangers and released Landlord for any injury or loss of life to guest; and
    • Whereas, guest and Landlord want to memorialize said assumption of risk;


    Now, therefore, for and in consideration of being allowed to rent said Villa and use said Pool, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the guest hereby releases Landlord, his heirs, successors, and assigns (collectively Releasees) from all liability for any physical injury or death to guest that results, directly or indirectly from the use (accidental or otherwise) of the Pool. The guest further agrees to indemnify and save and hold Releasees harmless from any loss, liability (accidental or otherwise), attorneys’ fees, damage, or costs that Releasees (or any of them) may incur arising out of or related to the use the Pool by the guest, whether caused by the negligence of the Releasees or otherwise.

    The guest fully understands that the use of the Pool involves risks and dangers of serious bodily injury, including death (Risks), and understands that the use of the Pool and surrounding area will not be supervised by any of Releasees, and the guest fully accepts and assumes all Risks and all responsibility for losses, costs, and damages the guest incurs as a result of use said Pool or surrounding area.

    This Agreement shall be governed by the laws of the Hellenic Republic (Greece). Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the Hellenic Association of Mediators then in force and effect.
